Governing consitution of the India Association at Missouri Universtiy of Science and Technology.

ARTICLE I – NAME and LOGO

  The name of the organization shall be the India Association.

Hereafter referred to as the association. The name and logo of the association cannot be changed until unless absolutely necessary and approved by the current advisor.

 

  ARTICLE II – OBJECTIVES

   

The objectives of the Indian Association shall be:

 

  1. To create a better understanding among the students from India and other nations by exchanging cultural , social, and educational thoughts and conducting various activities.
  2. To provide a means for free exchange of cultural and social ideas between the members of the association and other organizations on the campus and in the community.

     

ARTICLE III – ORGANIZATION

  The association will consist of following members and committees:

  President

  1. Advising Committee
  2. Primary Executive Committee
  3. Secondary Executive Committee
  4. General Members
  5. Associate Members

 

  ARTICLE IV – PRESIDENT

  Eligibility:

· Any general member of the Association is eligible to be the President of the association if and only if he is willing to stay on campus for the minimum of spring and fall semesters of his term.

· President will be elected by the general members of the Association.

 

Term:

·The term of the President will be from January to December of the current year.

 

Responsibilities:

· The President is responsible for conducting and presiding over general body and executive committee meetings.

·The President will responsible for all the events held under India Association banner.

·The President is responsible for smooth functioning of India Association and its various sub-committees.

 

Exit/Removal policy:

  • A president can be removed by the 2/3rd majority of the executive committee.
  • Upon removal, a new President will be elected by the executive committee for the remaining of the term. The new President will be awarded for the entire term as mentioned in the Term clause. The suspended President will no longer be entitled for any kind of presidential benefits and the newly elected President will be entitled for the benefits of the entire term.
  • A President can resign upon approval of 2/3rd majority of the executive committee. The outgoing President in this case is entitled for all presidential benefits up to the term he has served. A new president will be elected by the executive committee and the newly elected president will serve for the remaining of the term and will be entitled for benefits only for the term he has served.

 

  ARTICLE V – ADVISING COMIITTEE

  • The advising committee consists of advisors.
  • The association shall have one or more faculty advisors. Advisors will be elected by a majority vote of the regular members of the association.

   

ARTICLE VI – PRIMARY EXECUTIVE COMMITTEE

  Primary executive committee consists of following and will be elected by the general members of the association.

  • President
  • Vice President
  • Secretary
  • Treasurer

 

Eligibility:

  • As that of President.

 

Term:

  • As that of President.

 

 Responsibilities:

  • In absence of President, Vice President is responsible for all the activities of the association, in addition to it he should assist the President for smooth functioning of the association.
  • Secretary should attend all meetings send in the minutes of the meeting to all executive members.
  • Secretary should maintain the attendance record of all executive meetings.
  • Treasurer should maintain the funds wisely and should ensure that 25% of the remaining balance at the end of the year is transferred to the next committee in form of fixed deposits.

 

Exit/Removal Policy:

· As that or President.

   

ARTICLE VII – SECONDARY EXECUTIVE COMMITTEE

 

The committee will consist of the following sub-committees and will be elected by the primary executive committee:

· STUCO

· Sports

· Public Relations

· Cultural

· Multi-Purpose

· Food

· Movie

The total count of secondary committee should not exceed 25 members, and no more sub committees will be added.

 

Responsibilities:

  • Should perform all the duties as assigned by the primary executive committee.
  • Should help the primary executive committee in smooth organization of events.
  • Should promote India Association and increase awareness about Indian culture.

 

Exit/Removal Policy:

  • Primary executive committee members have a right to remove any person from secondary executive committee.
  • In case of biased decision of primary executive committee the member can appeal to the entire executive committee and then 2/3rd majority of the executive committee is needed to terminate him/her from the executive committee.
  • New member for the vacated post will be selected by the executive committee and benefits for the outgoing member as well as the new member will be decided with simple majority.

 

 

ARTICLE VIII – DISSOLVING OF THE EXECUTIVE COMMITTEE

 

  • If the general and associate members feel that the executive committee is not performing as per their expectations they have a right to dissolve the current committee and elect a new one.
  • General members can dissolve the executive committee on approval of advisor of the association and should have 2/3rd majority to dissolve the current committee.

   

ARTICLE IX – GENERAL/ASSOCIATE MEMBERSHIP

  Rules/Regulations:

  • To be eligible for regular membership in the association an applicant must be a student at the Missouri University of Science and Technology.
  • Applications for membership shall be made to the primary executive committee.
  • Associate membership shall be open to persons who support the objectives of the association but who are not students. They shall be known as associate members and shall have all rights of membership except those of holding office and voting.
  • Associate members are entitled only up to 4 free tickets for any kind of cultural show hosted by the Association.
  • All members of the association shall pay dues. Dues are payable at the beginning of each semester.
  • Nonpayment of dues by mid-semester shall automatically terminate membership in the association.
  • Any felony, misdemeanor, gross misconduct, or any behavior or activity that could be constructed as detrimental to the prestige of the association is a valid reason for denying membership. With the consent of the Executive Committee, the President may ask for the resignation of any member who does not live up to the objectives of the association. Any member asked to resign will be offered the opportunity to appear before the association and present evidence as to why he/she should not resign. In addition the President, with the consent of the majority of the executive committee of the association, may deny membership to any applicant.

   

ARTICLE X – MEETINGS

 

  • The executive committee shall call meetings at least once every month.
  • It is absolutely necessary for all the executive committee members to attend the meeting.
  • Secretary should take attendance in every meeting.
  • Non regular members should be penalized as per the article on attendance policy.
  • Treasure should inform all the members about the status of funds.

 

 

ARTICLE XI – ATTENDANCE POLICY

 

  • Attendance will be taken in every meeting.
  • Members who are unable to attend the meeting should inform the secretary before the meeting.
  • If a member is absent for 3 meeting in a term then the executive committee has rights to expel him/her from the post that he/she holds.

 

 

ARTICLE XII – AMENDMENTS/ RATIFICATION

 

· Executive committee has the right to amend the constitution.

· Strict procedures have to be followed for amending the constitution.

· The amendment has to be approved by the 2/3rd majority of executive committee members.

· After gaining the majority of the executive committee members it has to be approved by the advising committee.

· General / Associate members should be informed about the amendment.

 

  ARTICLE XIII – 2/3RD MAJORITY RULE

 

· Wherever 2/3rd majority is applicable it should be followed strictly.

· Incase the majority is not 2/3rd then the decision remains unchanged.

· Re-voting is possible only once and it should occur in the immediate next meeting if it fails again then the decision remains unchanged for the rest of the term.
